First PingTerms of Service

These Terms govern use of the First Ping website and service, operated by Keens Properties, LLC, a Pennsylvania limited liability company. Keens Properties, LLC does business as First Ping ("First Ping," "we," "us"), 4607 Library Road, Suite 220-805, Bethel Park, PA 15102. By using the site or buying the service, you agree to these Terms. Paying Clients also accept a Client Service Agreement at checkout; if it conflicts with these Terms, the Client Service Agreement controls.
1. The service
First Ping helps residential roofing companies ("Clients") respond to inbound leads (web forms, emails, and, once carrier registration is approved, text messages including missed-call text-back) with automated messages, qualifying questions, and appointment booking within rules the Client sets.
The service does not quote job prices, diagnose roofs, promise insurance coverage or claim outcomes, act as a public adjuster, or form a home-improvement contract between a Client and a homeowner. Appointments are scheduling requests under the Client's rules.
"No long-term contract" means month-to-month billing unless you choose an annual plan. These Terms and the Client Service Agreement still apply.
2. AI disclosure
Replies are generated or assisted by automated systems, including AI. They identify the roofing company and say they come from an automated assistant. They can be incomplete or wrong. A homeowner can ask for a person at any time.
3. Pricing and billing
Pilot: $197 at checkout, no setup fee. Go-live is the day your assistant starts answering your real leads after a successful test lead. If go-live hasn't happened within 14 days after checkout for reasons on your side, we treat day 14 as go-live. Your first $297 charge comes one calendar month after go-live, then $297 per month, billed in advance. Annual plan (available on request): $2,970 per year, paid in advance, with no pilot month. Founding offer (monthly plans only): the first five U.S. roofing companies who join keep $297 per month for 12 months from their first $297 charge. Prices exclude applicable taxes. Payments are processed by our payment provider. Except as stated in section 4 or where required by law, fees are non-refundable and partial periods are not prorated.
4. Billing, cancellation and founding pricing
After the pilot, service renews month to month at $297/month until canceled. Cancel by email to hello@tryfirstping.com before your next billing date to avoid the next charge. If you cancel before the first $297 charge (one calendar month after go-live), you won't be charged $297. Pilot refund: email hello@tryfirstping.com within 30 days after checkout to ask for a refund, and we'll refund your $197 pilot fee (and any $297 charge made in those 30 days) to your original payment method, and your service ends. This is available once per business and doesn't apply to the annual plan, which has its own refund below. We may suspend or end service for nonpayment, misuse, or legal or carrier compliance risk.
Annual plan. Available on request: $2,970 per year, paid in advance, with no pilot month, and it can't be combined with founding pricing. Cancel by email within 30 days of the annual charge for a full refund. After that, the annual fee isn't refundable except where the law requires. We'll email you at least 30 days before the renewal date with the price and how to cancel or switch to monthly. If we don't send that reminder, you can cancel within 30 days after the renewal charge for a full refund. You can switch to monthly billing at renewal.
Winter pause (monthly plans). After your pilot, you can pause once every 12 months, for up to 3 consecutive billing months between December 1 and March 31. Email hello@tryfirstping.com at least 3 business days before your next billing date. You pay $0 while paused. While paused, the assistant sends no messages to homeowners. Leads from a First Ping-hosted form are still emailed to you as a plain copy, and you'll need to handle all leads yourself. Service and billing resume automatically when the pause ends, or earlier if you ask. Founding pricing is kept, and your 12-month lock is extended by the months you paused. Annual plans can't be paused.
Founding roofer pricing. The first five U.S. roofing companies to sign up under the founding offer keep $297/month for 12 months starting with their first $297 charge (extended by any paused months). After those 12 months, the then-current standard price applies, with at least 30 days' notice by email of any change. The founding price applies to one business, can't be transferred, and ends if the account is canceled or ended for nonpayment; it isn't restored on re-signup.
5. Client responsibilities
Clients must provide accurate business information (including the legal name and EIN used for carrier registration), keep calendar availability current, have a lawful right to contact each lead, use our approved text-message consent language on their forms, honor opt-outs, and comply with the licensing and home-improvement laws that apply to them. Clients may not instruct the service to make false, deceptive, or unlawful statements.
6. SMS Terms
Program. First Ping lead follow-up messaging. Texts are sent on behalf of, and identify, the roofing company you contacted (for example, "Allegheny Peak Roofing Lead Follow-Up"). Each roofing company is the sender of its own messages.
Description. After you contact a participating roofing company (by web form, email, text, or a missed call to its business line) and agree to receive texts, you may receive automated, AI-assisted messages about your roofing inquiry: follow-up questions, appointment scheduling, confirmations, and reminders. These are not marketing messages.
Frequency. Message frequency varies based on your conversation and appointment. Messages the roofing company starts are sent only between 8:00 a.m. and 8:00 p.m. in your local time, and no more than three per day.
Rates. Message and data rates may apply.
Opt out. Reply STOP (or END, CANCEL, QUIT, UNSUBSCRIBE) at any time. You will receive one confirmation text, and no further texts unless you opt in again.
Help. Reply HELP for help, or email hello@tryfirstping.com.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Consent. Agreeing to receive texts is not a condition of any purchase or of getting an inspection.
Privacy. See our Privacy Policy. We do not share or sell mobile numbers or opt-in data to third parties or affiliates for marketing.
7. Free speed-to-lead audit
If we audit your business, we send one inquiry through your public web form, clearly labeled as a First Ping test, and report what automatic confirmation (if any) came back. We do not book fake appointments, place undisclosed test calls, or repeat the test if you ask us not to.
8. Acceptable use
Do not attempt to breach security, disrupt the service, send spam, or use First Ping for unlawful telemarketing or deception.
9. Intellectual property
The site, software, and branding belong to First Ping or its licensors. Clients keep their trademarks and their lead data, and grant us a limited license to use their name to send messages on their behalf.
10. No guarantee of results
We do not guarantee lead volume, reply times, appointments, jobs, or revenue. Calculators and sample conversations on our site are estimates or fictional examples. Reply times vary.
11. Disclaimers
THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUT IS NOT PROFESSIONAL, LEGAL, INSURANCE, OR CONTRACTING ADVICE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRST PING IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFIT DAMAGES, AND ITS TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR SERVICE IS LIMITED TO THE FEES YOU PAID FIRST PING IN THE THREE MONTHS BEFORE THE CLAIM AROSE.
13. Indemnity
Clients will defend and indemnify First Ping against claims arising from their leads and content, their failure to obtain required consent, their roofing or home-improvement work, and instructions they give us, except to the extent caused by our willful misconduct.
14. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. The state and federal courts in Allegheny County, Pennsylvania, have exclusive jurisdiction.
15. Changes
We may update these Terms by posting a new version with a new "Last updated" date. Material changes will be emailed to paying Clients. Continued use after the update means you accept it.
